Trade Secrets

Wrongful Termination
In most cases, an employee alleging discrimination must file a complaint with either the Equal Employment Opportunity Commission (EEOC), or the Arizona Civil Rights Division (ACRD), of the Attorney General’s Office. Employees must generally file a complaint within 180 days of the alleged violation, although in some cases the deadline is up to 300 days. Either agency will investigate the charge and/or issue a letter of determination, finding that there is reasonable cause to believe that there was a violation by the employer or simply issue what is called a “Right to Sue Letter” to the charging party. A Right to Sue Letter provides 90 days within which to file a civil lawsuit. It is not necessarily a determination upon the merits of the claim. A successful employee may recover monetary damages or equitable remedies such as reinstatement, compensatory damages and other damages. Discriminatory actions can include the withholding of a raise, failure to promote, unfair working conditions, denial of FMLA leave or wrongful termination.
Employment Discrimination
State and federal laws prohibit employment discrimination on many bases, including race, color, religion, sex, age, disability, national origin, genetic information and pregnancy. Federal laws include Title VII, the Americans with Disabilities Act (ADAA), Age Discrimination in Employment Act (ADEA), Pregnancy Discrimination Act (PDA), and the Equal Pay Act (EPA). Some cities, such as Phoenix and Tucson, have also enacted local ordinances expanding worker’s protections to include bases such as sexual orientation, marital status and other categories.
Employment Contract
Faulkner Law Offices has negotiated and drafted scores of employment and separation agreements on behalf of both companies and executives. With each engagement, we focus on the client’s goals and what is seminal for that particular agreement. For some clients, the primary focus may be the incentive compensation arrangement at the time of hire, while for others it may be the definition of “cause” in the employment agreement or the restrictive covenants at the time of hire or separation. Drafting and enforcing effective employment agreements is critical in any business relationship.

Non-compete Agreement

Severance Agreement
Arizona does not require employers to provide severance pay. Discharged employees must be paid all due wages within 7 working days or at the end of the next regular pay period, whichever is sooner. Employees who quit must be paid all due wages by the next payday.
Sexual Harassment
Victims of sexual harassment may sue under Title VII and/or the Arizona Civil Rights Act. We have handled scores of sexual harassment claims, ranging from derogatory comments, unwelcome touching and sexual assaults by supervisors against subordinate employees. Disability Discrimination
The Family and Medical Leave Act (FMLA), applies to companies with 50 or more employees. An employee who has been employed for a year, working the requisite number of hours, may be entitled to take up to 12 weeks of unpaid time off, if the employee or a family member suffers from a qualifying health condition. The FMLA prohibits retaliation for taking protected leave. Retaliation includes firing, demotion, or other adverse employment actions. FMLA leave can be intermittent, as needed, or ongoing.
