Wrongful Death
Last June a San Jose federal jury found that Taser International, manufacturer of the Taser stun gun, was 15 percent liable for Heston's death (Heston v. City of Salinas, No. C 05-03658 (N.D. Cal. 2008)). The jury determined that Taser International knew or should have known that "prolonged exposure" to its stun gun could lead to cardiac arrest, and also that the company had failed to warn Salinas police of that risk. The failure to warn, it found, was a "substantial factor" in causing the police officers to administer a prolonged shock. The jury awarded the Hestons $1 million in wrongful death damages, and it assessed $5.2 million in punitive damages--later struck as a matter of law--against Taser International. The verdict was the company's first courtroom loss, coming after 70 dismissals and settlements.
Traffic Violations
The defendant officer stopped the plaintiff for allegedly speeding in a school zone, and she refused to sign the citation. After a second officer and supervisor arrived, they told the plaintiff she was under arrest. She refused to leave her car, remaining in it with the ignition running and her door shut. An officer displayed his ECD, advising that it would hurt “extremely bad” if applied. When she stayed in the car, another officer opened the door, turned off the ignition and dropped the keys on the floorboard.

Robbery
LOS ANGELES - A man who was charged with armed robbery is suing the city of Los Angeles, its Police Department, Chief William J. Bratton and three detectives for holding him in custody for 27 months and allegedly suppressing evidence he claims they knew would have exonerated him.
Burglary
Juarez, a plaintiff in the class-action lawsuit, spent 105 hours in jail without going before a judge. He later was convicted of burglary.
Misdemeanors
Richards, who had been arrested on a misdemeanor drug charge, stopped breathing and suffered irreparable brain damage that has left him in a vegetative state, said Bell. He is now in a nursing home in Northridge.
Assault
Murder
Wednesday the Supreme Court will hear arguments in two interesting cases. In Connick v. Thompson the Orleans Parish District Attorney’s Office is challenging a jury award of $14 million in favor of John Thompson, who was framed for murder and came within weeks of his scheduled execution date. All tolled, Thompson spent more than 18 years in Louisiana’s notorious Angola Penitentiary, mostly in solitary confinement on death row.
Arson
The FBI has agreed to pay $100,000 to settle a lawsuit filed by an environmentalist mistakenly jailed for a string of arson attacks targeting more than 100 vehicles, according to lawyers in the case.
Restraining Order
Ing served with a restraining order. She was cuffed, hobbled, and put in a police car, with the hobble cord secured to the door. On the way to jail, she loosened the hobble. While the hobble was being re-secured, a deputy drive-stunned her twice, once underneath her breast and once on her inner thigh, the latter leaving a scar.

Workers Compensation
The alleged harassment culminated in June 1994 when Lee-Carey, who is black, was injured during a physical altercation with a male sheriff's deputy in the briefing room at the Metro Blue Line station. She contends the argument was racially motivated. She hasn't returned to work since the incident and has been granted a disability retirement. A workers' compensation proceeding is pending.
Employment Discrimination
The SEIU bureaucracy made a deal with a new contractor to replace the plaintiff security guards in the high-rise adjacent to Penn Station with lower-paid workers, which resulted in a grievance claiming violations of federal age discrimination laws as well as seniority rights. At the arbitration hearing, the SEIU withdrew the age discrimination claims because of a “conflict of interest”—namely, that the reassignments were made possible by the union’s own deal with the new contractor.
