If you are arrested and or charged with DUI (driving under the influence), you will need a good quality attorney. There are a lot of good quality attorneys in southeast Michigan; James G. Schmier (jschmier@dui-detroit.com)/ DUI-Detroit (Birmingham, MI) is not one of them. Do not invest in this attorney, He, Schmier is inconsistent and conflicting. He says (has said) different things concerning the same subject; all inconsistent and conflicting. He is a pathological LIAR. While representing Case No. GC 09 1653 in the Michigan 46th District Court, he did nothing. He didn't know what to do but he did do this. He, Schmier presented to the Michigan Attorney Grievance Commission a bogus retainer agreement. According to Schmier, he submitted (2) copies of his retainer agreement to client via U.S. Mail but never received either of the (2) copies back. Laugh. Go ahead and laugh. Laugh, laugh, laugh. Schmier NEVER prepared or submitted (2) copies of his retainer agreement to client. Conversation concerning a retainer agreement between Schmier and client NEVER surfaced. Laugh. Go ahead and laugh. Laugh, laugh, laugh. He Schmier does not know law. How he ever acquired a law license is yet a mystery.

Child Support
Public order crimes is any conduct that interferes with the normal course of life. This conduct includes many crimes such as failing to pay child support, failing to stop for the police when they give you a lawful order, or being intoxicated in public and causing a disruption because you were drunk.
Child Abuse
The decision to have a preliminary exam is generally up to the defendant, however in some instances the prosecutor or the judge may demand that a preliminary exam be conducted. This is especially true in child abuse or spousal abuse cases where the prosecutor wants to preserve testimony. At the exam, the Defense typically does not call witnesses. On the other hand, the prosecution will present their witnesses to show that there is probable cause to believe that a crime was committed and that the defendant might have committed the crime. The burden of proof is "probable cause" which, if you could measure it, is 51% certain. In contrast, at a trial, the prosecutor must prove that you committed the crime "beyond a reasonable doubt" which is about 98% certain. And where at a trial, the jury makes the decision or the judge in a bench trial, in a preliminary exam, the judge listens to the prosecutor's evidence and makes the decision. Obviously, at 51%, it does not take much evidence for the judge to bind the case over to Circuit Court.
