Property Damage
This was a complicated insurance coverage dispute arising out of a substantial property damage claim at the Troy Sports Center, the premier ice-skating facility in Southeastern Michigan. Plaintiff was an insured on a commercial policy issued by Defendant. Affiliated is a wholly owned subsidiary of Factory Mutual Insurance Company, part of the FM Global Insurance Group, which provided claims adjusting services for Affiliated insureds, including Plaintiff. The policy issues related to whether the property damage fell within the policy definition of "occurrence" - "arising from" or "caused by" a "discrete event of physical loss or damage." Defendant asserted various "Group II" exclusions, including wear and tear, corrosion, subsidence of floors, etc. All of the exclusions had the same "resulting damage" exception. The costs of repairs approximated $14,000,000, plus policy benefits such as business interruption, extra expense, mandatory statutory penalty interest, etc., increasing the total damage claim to an amount in excess of $20,000,000. The case was amicably resolved at mediation.

Medical Malpractice
Parekh v PICOM, the Defendant insurer refused to settle a medical malpractice claim within the policy limits, after the physician-insured had twice demanded it do so. The jury subsequently returned a verdict that was 10 times the amount of the coverage. However, the doctor’s “collectible estate” was more than sufficient to satisfy the verdict. This case involved a claim of bad faith against the insurer. We aggressively litigated this case and fully prepared it for litigation. We retained renowned experts in the area of bad faith litigation as Michigan has very little law to support such claims. We were eventually able to settle the case on very favorable terms to our client. We believe that the key to settling this matter was identifying the weaknesses in PICOM’s case and pointing these out to the head of PICOM. When he saw things our way, the case settled very favorably to our client. To this day, the attorneys for the underlying Plaintiffs, both their primary counsel and collection attorney send their insurance coverage litigation to Mr. Feldman, or consult with him when insurance issues predominate in their other matters.
